2008 Constitution

PREAMBLE
WE THE POLITICAL SCIENCE STUDENTS OF COLEGIO SAN JAUN DE LETRAN,
IMPLORING THE AID OF ALMIGHTY GOD, IN ORDER TO BUILD A MATURE AND
RESPONSIVE SOCIETY, DEVELOP OUR POTENTIALITIES, AND PROMOTE OUR
HOLISTIC DEVELOPMENT, DO ORDAIN AND PROMULGATE THIS CONSTITUTION:

ARTICLE ONE

NAME OF ORGANIZATION, SEAL, AND DOMICILE
Sec. 1 The organization shall be officially called Letran POLITICVS

Sec. 2 a.) The Organization shall adopt an insignias which shall
reflect the organizations
Principles. Such symbol shall be approved by 2/3 of all members in the
organization.
b) Any proposed changes in the organization symbol shall be presented
to all its
the members, which shall approve such changes by a two-thirds (2/3)
vote of all
its members during a General Assembly.

Sec. 3 Domicile for the LETRAN POLITICVS shall be at Colegio de San
Juan de Letran, Marulla St., Intramuros, Manila
 
ARTICLE TWO

DECLARATION OF PRINCIPLES
Sec. 1 The LETRAN POLITICVS is a democratic and republican
organization. The power resides in its members and all authority
emanates from them.

Sec. 2 The LETRAN POLITICVS renounces violence as an instrument of
societal policy and adheres to the generally accepted principles of
peace, unity, equality, freedom, cooperation, and unity among its
members and the rest of society.

Sec. 3 Letran Politicvs is a co-curricular organization, the prime
objective if which is to promote the holistic development of its members.

Sec. 4 The organization adopts as one of its policies the
formation of politically aware, mature, and responsive citizenry.
Towards this end, the organization shall take an active part in local
and national issues that concern the general welfare of the Filipino
people.

Sec. 5 The organization adheres to the principles of grassroots
democracy. Towards this end, it shall encourage the involvement of all
its members in all its activities. It shall protect and strengthen the
basic and autonomous political subdivision, and shall enhance their
participation, cooperation in the organization.

Sec. 6 The organization values the dignity of its members and
guarantees full respect of their rights granted by this constitution
and all rights granted by the Philippine Constitution.

Sec. 7 The LETRAN POLITICVS is a sovereign and self-reliant
organization. It shall not be subjected to external control. Its
decisions on internal matters shall be final and executory

Sec. 8 The LETRAN POLITICVS has the authority to establish measures
against unreasonable acts and practices that would hinder the
performance and administration of duties of its officers and members.

Sec. 9 It is the policy of the organization to discourage acts,
practices that prescribe or improve any political doctrine through
force, undue influence, or intimidation.

Sec. 10 It is the policy of the organization to recognize the
necessity of the observation, promotion, and enjoyment of human rights.

Sec. 11 As a democratic organization, it is the policy of this
organization not to violate in any manner and extent the free
enterprise of ideas and expression among members.

Sec. 12 The LETRAN POLITICVS shall take measures to preserve and
protect a healthy ecological balance in its environment and the rest
of society.
ARTICLE THREE

MEMBERSHIP
Sec. 1 All bonafide Political Science Majors enrolled in the
Colegio de San Juan de Letran shall, ipso facto, become members of the
organization.

Sec. 2 Non-political science majors, who wish to be a member of the
organization, shall be admitted upon completion of the necessary
processes as may be determined by law promulgated upon by the
executive council or the organization.

Sec. 3 Membership may be lost in the following manner and instances:

a.) By shifting to any other major field of study
b.) By transferring to other educational institution
c.) By the time a member completes his/her degree in the field of
political science
d.) Discontinuance of his/study
e.) Expulsion
f.) Non payment of the membership fee for 3 consecutive regular semesters.
ARTICLE FOUR

BILL OF RIGHTS
Sec. 1 It is the of every member to avail of any benefit and
privileges the organization extends to its members

Sec. 2 Every member shall have the right to equal treatment and protection

Sec. 3 All members shall have the right to express their views on
matters concerning the organization and shall have the opportunity to
be heard by the body.

Sec. 4 The right of every member to information on matters concerning
the organization shall be recognized. Access to official acts,
transactions, or decisions shall be undeniable.

Sec. 5 It is the right of every member to peaceably assemble and
petition the officers of the organization for redress of grievances.

Sec. 6 Any member under investigation shall have the right to due
process. No force, undue influence, intimidation, or any other means
which vitiate the free will, shall be used against him/her.

Sec. 7 The right to form, join and participate in other association
and societies having purposes not contrary to the laws and policies of
the organization, the college, and the Republic of the Philippines
shall be inalienable.

Sec. 8 It shall be the right of every member of the organization to
vote in the organizations election, plebiscite, referenda.
 
ARTICLE FIVE

DUTIES AND OBLIGATIONS
Sec. 1 It shall be the duty of every bonafide member to be loyal to
the organization, to uphold its constitution, obey its by-laws, and
contribute to the fulfillment of its goal and objectives.

Sec. 2 The rights of the members impose upon the co-relative duty to
exercise these rights with responsibility.

Sec. 3 It shall be the duty of all members to keep themselves informed
of any matter concerning the organization, and actively participate in
any meeting, activity or program duly sanctioned by the organization.

Sec. 4 It shall be the duty of all the members of the organization to
pay the respective dues and fines duly imposed by the organization.

Sec. 5 It shall be the duty of each member to conduct themselves in a
dignified manner.

Sec. 6 It shall be the duty of each member to promote and protect the
interest of the organization and its members.

 

ARTICLE SIX

THE LETRAN POLITICVS EXECUTIVE COUNCIL
Sec. 1 There shall be an executive council composed of all the elected
officers and chairpersons of the standing committees.

Sec. 2 The LETRAN POLITICVS executive council shall serve as the
legislative and executive body of the organization.

Sec. 3 The executive council shall meet regularly at least once every
month, or upon a call of the President for a special meeting.

ARTICLE SEVEN

OFFICERS
Sec. 1 The officers of the organization shall include the following:
President, Vice-President for Internal Affairs, Vice-President for
External Affairs, 5 Senators who shall be elected at large, and two
(2) elected representatives from each of the four year levels, who
shall be ex-officio senators. These officers shall compose the
executive council of the Letran Politicvs.

Sec. 2 The Letran Politicvs Secretary-General shall be appointed by
the President in his/her discretion, and shall have no voting rights
in the executive council.

The Letran Politicvs shall adhere to all democratic principles, in
accordance with
the fundamental law of the land and its by laws.

Sec. 2 The organization shall see to it that all its policies,
programs, and activities will
develop, enhance and motivate the holistic development of
its members.

Sec. 3 The President shall have the following powers, functions and
responsibility:
a.) To serve as the official representative of the organization.
b.) To call and preside over all assemblies and affairs of the
organization.
c.) Call and preside over all meetings of the organization
d.) To manage and supervise the programs and activities of the
organization.
e.) To appoint the Secretary of the organization and all other
appointive position in the council.
f.) Approve all financial spending of the organization with the
concurrence of the council.
g.) The president shall also have the power to veto resolutions passed
by the council. The veto of the president can be overturned by a
two-thirds vote of all members of the council.
h.) Shall represent the organization in all functions and events
within and outside the colegio.
i.) To exercise such duties and functions as may be delegated to
him/her subject to the limitation of this constitution.
Sec. 4 The Vice-President for Internal Affairs shall have the
following powers, functions and responsibility:
a.) In the Absence or incapacity of the President, shall take charge
of all responsibility and duties of the president until such time that
the president is able to assume the responsibility of the Office of
the President.
b.) He/She shall also have direct supervision over all activities
within the organization.
c.) Shall function as the liaison of the organization in the Office of
Student Affairs and other offices within the Colegio. He/She shall
likewise take charge of the filing of accreditation as an organize
student organization of the colegio.
d.) Shall take charge of the recruitment committee of the organization
e.) To exercise such duties and functions as may be delegated to
him/her by the council.
Sec. 5 The Vice-President for External Affairs shall have the
following powers, functions, and responsibility:
a.) Shall assume the supervision of external activities of the
organization.
b.) To coordinate and build external linkages with institutions,
organizations, and other groupings which shall be beneficial and cater
to the needs and programs of the organization.
c.) Represent the organization in functions and events outside the
colegio.
d.) To exercise such duties and functions as may be delegated to
him/her by the council.
Sec. 6 The Senators shall serve as the chairpersons of the standing
committees upon the appointment of the president. The Senators and
ex-officio Senators shall be eligible for membership in two committees.

Sec. 7 The Year Level Representatives shall take charge in activities
and programs within their respective batches and shall be responsible
in informing its members of the activities and programs of the
organization. Likewise, it shall be the primary responsibility of the
batch representatives to inform the council of the sentiments of the
members of the organization.

Sec. 8 In case of death, permanent disability, removal from office,
suspension, or resignation of the President during the regular
semester, the Vice-President for Internal Affairs shall become the
President to serve the unexpired term. In case of death, permanent
disability, removal from office, suspension or resignation of both,
the President and Vice-President for Internal Affairs, the
Vice-President for Internal Affairs, shall then act as the President.

Sec. 9 Whenever there is vacancy in the Office of the Vice-President
for Internal Affairs, or the Vice-President for External Affairs, the
Senator with the highest number of vote shall take over and office of
the vacant seat and shall serve the unexpired term.

Sec.10 Whenever there is vacancy in the office of the Senator/s, the
same shall be filled in through special election duly called for by
the council.

ARTICLE NINE

STANDING COMMITTEES
Sec. 1. There shall be five (5) standing committees with the following
functions:
a.) Academics- It shall have the primary task of formulating and
carrying out policies that will develop the intellectual and academic
development of the members of the organization.
b.) Finance- It shall assume the responsibility of handling and
managing the funds of the organization. It shall also have the
responsibility to come up with an efficient process of collecting the
membership fees, safeguard, and make bi-monthly reports which shall be
posted in the organization bulletin board and other forms of
communications accessible to the general membership.
c.) Complaints and Grievances- It shall handle investigations
regarding petitions for impeachment of officer/s. It shall receive
reports, complaints, grievances submitted to it by any member of the
organization. It shall investigate disputes referred to the
organization and give recommendations thereafter. It shall perform any
other function that the organization may deem for it necessary for its
operations.
d.) Socio-cultural –It shall initiate programs aimed to promote the
social and cultural development and awareness of the members of the
organization, and to discover and/or enhance the skills and talents of
the same.
e.) Information and Public Relations- It shall disseminate information
regarding the activities, programs, and reports of the organization.
Likewise, the committee is also tasked to further promote the course
in and outside the colegio.
ARTICLE TEN

QUALIFICATIONS FOR LETRAN POLITICVS EXECUTIVE COUNCIL OFFICERS
Sec. 1 No person may be elected President, Vice-President for
Internal Affairs and Vice-President for External Affairs unless he/she
is a citizen of the Philippines, a bonafide member of the
organization, majoring the course of AB-Political Science only in the
Colegio de San Juan de Letran, must have at the least a third year or
a fourth year status and an academic resident of the colegio for at
least 2 consecutive semester immediately preceding the election.

Sec. 2 No person shall be elected Senator unless; he/she is a citizen
of the Philippines, a bonafide member of the organization.

Sec. 3 No person shall be elected Senator ex-officio or Batch
Representative unless he/she belongs to the batch he/she is representing.

ARTICLE ELEVEN

TERMS OF OFFICE

 

Sec. 1 All officers shall have a term of office of one academic year.

Sec. 2 The President and Vice-Presidents shall be entitled to one
re-election for the same office.

Sec. 3 The Senators and Senators Ex-officio shall be entitled to one
possible re-election for the same office.

ARTICLE TWELVE

ACCOUNTABILITY OF OFFICERS

Sec. 1 Public office is a public trust, officers must at all times be
accountable to the Organization, must serve them with utmost
responsibility, integrity, and efficiency.

Sec. 2 The President, Vice-Presidents, Senators and Ex-officio
Senators may be removed from office by impeachment based on the
following grounds:
a.) Grave violation of the Letran Politicvs Constitution
b.) Grave abuse of power
c.) Gross negligence of duty
d.) Graft and Corruption
e.) Unreasonable absences in major activities and meetings of the
organization.
Sec. 3. The impeachment proceedings shall be conducted in the
following manner:
a.) A petition paper with a signature of at least twenty percent of
the total number of members of the organization shall be submitted to the committee on complaints and grievances. The committee shall then conduct proper investigations on the matter to ensure that due process is observed. The findings shall then be submitted to the executive council. For an officer to be impeached, a two-thirds vote of all members of the organization shall be required through secret balloting.

Sec. 4 The officer who is subjected fir impeachment shall
automatically be suspended from this office upon the filling of the
petition against him, until such time that the case is resolved.


ARTICLE THIRTEEN

ELECTIONS
Sec. 1 The election of officers shall be held on a Friday, Three weeks
before the end of the semestral break of the second semester during a
General Assembly duly called for, for the purpose of conducting an
election.

Sec. 2 There shall be a campaign period of four days which will end by
six o'clock in the afternoon a day before the elections.

Sec. 3 Guidelines pertaining to the registration and accreditation of
the candidates, the campaign period, and the election of proper shall
be issued three months before the date of elections.

 

ARTICLE FOURTEEN

FEES AND FUNDS
Sec. 1 Dues in the organization shall be 150 pesos per semester, to be
automatically added in the dues together with the tuition and other
matriculation fee.

Sec. 2 Members failing to pay their dues shall be notified in writing
by the Finance committee chair for their delinquency, and if the dues
are not paid thereafter, they shall be dealt with accordingly.
 
ARTICLE FIFTHEEN

AMENDMENTS OR REVISIONS
Sec. 1 Any amendment to, or revision of, this Constitution may be
proposed by:

a.) The Executive Council, upon three fourths vote of all its members; or
b.) A constitutional convention duly called for by the executive
council by a majority vote or by the General Assembly.
Sec. 2 Any amendment to, or revision of, this Constitution under
Section 1(a) hereof shall be valid when ratified by a majority vote of
the votes cast in a plebiscite which shall be held not earlier than 10
days nor later than 20 days after the approval of such amendment or
revision.

Sec. 3 Any amendment under Section 1(b) hereof shall be valid when
ratified by a majority vote of the votes cast in a plebiscite which
shall be held not earlier than ten days (10) nor later than twenty
days (20) after the approval of such amendment or revision.

ARTICLE FIVETHTEEN

TRANSITORY PROVISION
Sec.1 The first elections of officers under this constitution shall be
held on the third Friday of June, 2008.

Sec.2 All officers elected during the first election under this
constitution shall serve a complete term till the next scheduled
elections.
